Describing features that are not yet available does not by itself mean they can be purchased or will be introduced on a particular date.
Only entitlements whose contents and fulfilment conditions are clearly defined at the time of purchase may be offered as paid services.
4. Conditions for using the service
To use New Era Rust, players must have:
A lawfully usable copy of the Rust video game.
The Steam account required for the game.
An appropriate internet connection.
The hardware and software environment required to run the game.
Valid access required to use the server.
Players must comply with the applicable rules of Rust, Steam and related platforms.

Players are responsible for securing their own Steam account and adequately protecting their login credentials.
5. Age requirements and eligibility
Purchasers must be at least 16 years old to make purchases through Tebex Checkout.
Players under 18 may need parental or legal representative consent under applicable laws and platform rules.
Players and purchasers may not use another person's payment method without appropriate authorization.
New Era Rust is not responsible for consequences arising from false information supplied by a user where those consequences are not attributable to the operator.
6. Tebex Checkout and the purchase contract
Digital products in the New Era Rust store are sold through Tebex Checkout.
Under Tebex's Merchant of Record model, Tebex, or the seller identified in the Tebex contract applicable to the purchase, is the purchaser's contractual merchant.
Tebex's responsibilities include, in particular:
Providing the payment process.
Managing supported payment methods.
Processing the purchase transaction.
Handling applicable tax obligations associated with the sale.
Providing purchase confirmations.
Handling payment disputes and refunds under the applicable terms.

In the event of a conflict, the priority of Tebex's purchase terms and consumers' mandatory statutory rights must be respected.

7. Digital products and entitlements
Services available in the New Era Rust store are digital in nature.
Purchased products may include, in particular:
VIP membership entitlements.
In-game convenience services.
Server connection priority entitlements.
Digital services specified in the product description.
In-game benefits specified in the product description.
Digital entitlements may be used only on the New Era Rust server.
Purchases do not confer ownership of the Rust video game or its infrastructure.
Digital products are for personal use. Transferring, selling or sharing entitlements with a third party is permitted only where expressly authorized by the relevant product description or the operator.
Products have no guaranteed monetary value outside the game and cannot be exchanged for real money.
In-game entitlements are not investments, financial instruments or promises of financial returns.
8. VIP membership system
New Era Rust may offer four VIP membership tiers:
Silver VIP Gold VIP Diamond VIP Emerald VIP
VIP memberships are optional paid digital services.
The contents and price of each membership are defined on its product page.
8.1. Potential VIP benefits
Depending on the plan, VIP memberships may provide:
Different levels of server connection priority.
An in-game VIP badge.
A custom in-game interface.
Membership information and validity details.
Convenience features.
Periodic in-game rewards.
Private storage for rewards.
An automatic reward-claim preference.
Certain gameplay or economic convenience benefits.
This list does not mean that every benefit is included in every VIP plan.
The exact contents must always be interpreted according to the relevant product description.
8.2. Connection priority
VIP membership may provide a certain level of priority when connecting to the server.
Priority concerns management of the waiting order; it is not an unconditional guarantee of immediate access.
The server's technical condition, availability, capacity and other security requirements may restrict access.
8.3. VIP rewards
The system may provide membership rewards under the rules of the relevant plan.
Earning rewards may depend on specified playtime, activity or other conditions described in the product description.
Detailed conditions for AFK status, playtime accounting and reward delivery are specified in the relevant service description.
Reward delivery may involve technical checks and abuse-prevention mechanisms.
Where playtime is manipulated, bugs are exploited or rewards are claimed without authorization, improperly acquired rewards may be revoked following an appropriate investigation.
8.4. VIP storage
The VIP system may provide private reward storage.
Physical in-game items held in storage are subject to the server's wipe policy.
Storage is not a financial deposit or a guarantee that physical items will be retained indefinitely.
8.5. Changes to memberships
The operator may modify VIP plans offered for future sale as the server develops.
Changes affecting the essential contents of services already purchased are governed by the terms disclosed at purchase, applicable laws and relevant Tebex rules.
Material, adverse changes to prepaid services cannot be made without limit merely by referring to this general amendment provision.
9. Subscriptions and automatic renewal
Certain VIP plans may be available as monthly recurring subscriptions.
9.1. Creating a subscription
A subscription is created through a successful order in Tebex Checkout.
Before purchase, the following must be displayed:
The subscription price and currency.
Payment frequency.
Plan contents.
Subscription renewal conditions.
How to cancel.
Any additional conditions.
Monthly subscriptions may automatically renew at the specified intervals until cancelled by the purchaser or until the service ends for another lawful reason.
9.2. Managing a subscription
Players can monitor and manage their subscriptions through Tebex.
Subscription management is available at:
https://checkout.tebex.io/payment-history
Subscription emails sent by Tebex may also include a cancellation option.
9.3. Cancelling a subscription
Players may request subscription cancellation at any time through the methods provided by Tebex.
After cancellation, no further recurring charges may be made for that subscription, without prejudice to the terms concerning payments already due and lawfully processed.
Entitlements for a prepaid service period generally remain valid until it expires, unless different termination or suspension conditions lawfully apply.
9.4. Failed renewal
If a subscription payment fails or is missed, membership may end or become inactive according to the subscription status managed by Tebex and the related service terms.
The operator is not obliged to provide VIP benefits for unpaid periods.
9.5. Price changes
Players must be informed of material subscription price changes in accordance with applicable laws and Tebex terms.
Changes must not result in unilateral price increases that infringe consumers' statutory rights.
10. Fulfilment of purchased services
After successful payment processing, digital entitlements are assigned to the player account associated with the purchased product.
Fulfilment may take place through automatic in-game commands, web integration or customer support intervention where necessary.
Purchasers must use the correct Steam identifier or other identifier required during checkout.
The relevant product description must state expected activation times and any prerequisites.
In the event of a technical error, players may request an investigation into fulfilment.
A support request may require:
The transaction identifier.
The SteamID.
The name of the purchased plan.
The purchase date and time.
A brief description of the problem.
Players are not required to provide full card details or payment passwords.
If a product is not fulfilled properly, the operator will work with Tebex to correct the error or provide any further remedy lawfully required.
11. Server wipes and data persistence
Periodic wipe events may form part of operating the Rust server.
A wipe is a server event that may reset parts of the game world and in-game progress.
11.1. Data that may be cleared by a wipe
A wipe may remove, in particular:
Physical items held in players' inventories.
Physical items placed in the game world.
Player-built structures.
Physical items in private VIP storage.
In-game resources tied to the relevant wipe cycle.
Server state data limited to a particular period.
Wipes may be a predefined or technically justified part of server operation.
11.2. Persistently retained entitlements
Under New Era Rust's planned persistent entitlement system, the following data and entitlements survive ordinary wipes:
Coin balances.
Unused digital case keys or related entitlements, if the relevant feature operates.
Acquired skins.
Acquired cosmetic entitlements.
The recorded status of active VIP subscriptions.
This data belongs to the server's digital records and is not considered physical items placed in the game world.
Persistence means retention within New Era Rust across ordinary wipe cycles, not a guarantee of perpetual availability or use after the server closes.
11.3. Wipes and purchases
Before purchasing, players must review a product's wipe sensitivity where relevant to its nature.
Losing physical items during an ordinary wipe does not by itself constitute defective service delivery if clear, adequate information was provided before purchase.
This provision does not limit consumers' statutory rights arising from inadequate or defective fulfilment.
12. In-game Coins and digital balances
The server's Coin system is exclusively an in-game feature.
A Coin balance:
Is not legal tender.
Is not electronic money.
Is not a bank account balance.
Does not create a claim for real money.
Does not guarantee a value measurable in real money.
Cannot be exchanged for cash.
Cannot be exchanged for cryptocurrency or external financial instruments.
Coin balances may be used only for in-game purposes authorized by New Era Rust.
Balances acquired without authorization or by exploiting technical errors may be corrected after appropriate review.
The operator reserves the right to make justified future changes to the economy while respecting purchased entitlements and mandatory consumer rights.
Selling Coins or other digital entitlements for real money, or linking them to random rewards, is permitted only if the arrangement complies with applicable laws and Tebex rules.
13. Player conduct and prohibited activities
New Era Rust expects every player to behave fairly and follow community rules.
The following are prohibited in particular:
Using cheats, unauthorized software or prohibited modifications.
Deliberately exploiting server errors to gain unauthorized advantages.
Manipulating in-game economies, rewards or subscription entitlements.
Denial-of-service or other cyberattacks against the server or other players.
Unauthorized access to other players' accounts.
Unauthorized acquisition or disclosure of personal information.
Harassment, threats, hate speech and other seriously abusive behaviour.
Deceiving other players for prohibited commercial or fraudulent purposes.
Unauthorized circumvention of bans or security restrictions.
Unauthorized copying, transfer or resale of paid entitlements.
The server's official rules may provide further gameplay requirements.
14. Moderation and penalties
The operator may apply moderation measures to maintain order on the server.
Measures may include:
Warnings.
Temporary communication restrictions.
Temporary bans.
Permanent bans.
Removal of improperly acquired assets.
Restricting access to features affected by abuse.
When determining measures, we consider the violation's severity, repetition, supporting evidence and impact on the community.
A serious security threat may justify immediate action.
VIP membership does not exempt players from server rules.
14.1. Paid membership and bans
Players with active VIP memberships may also be banned for violating server rules.
A lawful ban imposed for a violation may affect the practical use of paid entitlements.
A ban does not by itself create an automatic refund entitlement; the matter must be assessed under the purchase terms and applicable consumer protection laws.
A ban does not automatically cancel a recurring subscription managed by Tebex. To prevent further charges, players can request cancellation through Tebex or seek customer support assistance.
14.2. Appeals
Players may request a review of moderation measures through official support channels.
Requests may include the player identifier, the time of the measure and the grounds for review.
The operator reviews requests using the available data and evidence.
15. Raid, PvP and gameplay rules
New Era Rust may use custom mechanics and optional game modes.
Where an opt-in raid or PvP system operates, its detailed conditions are defined in separately published gameplay rules.
Players must follow server restrictions when using such systems.
Technical exploits or workarounds that improperly bypass active protection mechanisms are prohibited.
The operator may restore the system's intended operation and take action against abuse.
16. Technical availability and maintenance
New Era Rust seeks to provide stable, secure and continuous operation.
However, online game servers may be affected by:
Scheduled maintenance.
Software updates.
Rust game updates.
Hosting and network problems.
Security incidents.
Failures of third-party services.
Unforeseen technical events.
Server use does not include an unconditional guarantee of uninterrupted access.
The operator takes reasonably expected measures to resolve faults and restore service.
Material, prolonged or repeated outages of paid services may entitle players to appropriate remedies under applicable law.
17. Refunds and purchase complaints
Purchase contracts made through Tebex Checkout are subject to Tebex's applicable refund and purchase terms.
Given the nature of digital products, refunds without a reason may be limited after fulfilment.
However, nothing in these Terms excludes or limits consumers' mandatory statutory rights.
17.1. Refund-related cases
Purchasers may request an investigation particularly where:
A purchased entitlement was not activated.
The product does not match its description at purchase.
The service was not properly delivered.
They identify an incorrect or unauthorized charge associated with the purchase.
Applicable law grants a right of withdrawal, termination or another remedy.
17.2. Right of withdrawal
Withdrawal or termination rights for digital content and services may depend on the relevant country's laws, the nature of the service, commencement of performance and declarations given at purchase.
Rules concerning loss of the right of withdrawal apply only where the statutory conditions are met.
These Terms do not affect mandatory rights arising under EU or other applicable consumer protection rules.
17.3. Refund procedure
Purchase complaints may be handled through Tebex's official support system.
New Era Rust customer support may also be contacted about technical errors affecting in-game fulfilment.
New Era Rust: hello@azuryth.co.uk
Tebex: https://www.tebex.io/contact/checkout
The operator may provide the technical and fulfilment information needed to investigate a refund request.
18. Defective fulfilment and service complaints
If a purchased service does not operate correctly, players may contact customer support.
When investigating an error, we examine:
The validity of the purchase and entitlement.
Server-side fulfilment logs.
Conditions associated with the product.
Any technical failure.
An appropriate recovery option.
If a feature provided by the operator malfunctions, we seek to correct it or provide the appropriate service.
Consumers may also be entitled to other remedies where required by law.
19. Intellectual property
The Rust video game, its original graphics, name and associated intellectual property rights belong to their respective rights holders.
New Era Rust's custom-developed systems, original branding, web content and bespoke software solutions are the intellectual property of the relevant rights holders.
Using the server does not grant permission to copy, resell or commercially exploit this content without authorization.
Software and content licensed from third parties are subject to the relevant rights holder's licence terms.
New Era Rust is an independent community project with no official affiliation with Facepunch Studios.
20. User content and community communication
Players are primarily responsible for content they publish on the server, in chat or on community platforms.
Players must not upload or distribute unlawful content, content infringing others' rights or content violating server rules.
New Era Rust may moderate or remove content that violates its rules, in accordance with applicable law.
Using the community platform does not automatically transfer all a player's copyright to the operator.
Submitted development ideas, votes and suggestions do not automatically create payment or ownership claims concerning future server developments.
The operator decides whether to implement community ideas, taking technical, legal and economic circumstances into account.
21. Liability and its limitations
The operator seeks to maintain proper server operation and fulfil the services it undertakes to provide.
However, it does not unconditionally guarantee that the service will be available without errors or interruptions at all times and in all circumstances.
Players are responsible for their gaming equipment, internet connection and secure use of their user account.
The operator's liability is governed by applicable law.
These Terms do not limit or exclude:
Liability that cannot be excluded by law.
Consumers' mandatory warranty or other remedy rights.
Liability for fraud or intentional wrongdoing that cannot lawfully be excluded.
Liability for death, personal injury or harm to health that cannot lawfully be excluded.
Claims for damages and other remedies must be assessed according to the circumstances, the relevant contract and applicable laws.
22. Abuse, fraud and unauthorized transactions
New Era Rust and Tebex may investigate suspicious purchases, suspected fraud and unauthorized digital entitlements under the applicable rules.
If a purchase is reversed, refunded or invalidated, the related in-game entitlements may also be appropriately modified or revoked.
Submitting a lawful complaint, refund request or payment dispute is not by itself a rule violation.
The operator applies fraud-prevention measures proportionately and respects players' rights.
23. Modification or discontinuation of the service
The operator may develop, modify, maintain or, where justified, discontinue the New Era Rust server.
Changes may arise particularly for technical, security, economic or legal reasons.
We provide appropriate information about material changes affecting purchased services where required by applicable laws or contractual terms.
If the server permanently closes or paid services are materially discontinued, outstanding obligations and consumer rights must be addressed under applicable laws and Tebex purchase terms.
This clause does not grant an unlimited right to terminate prepaid services without compensation.
24. Privacy
Processing of players' personal data is described in New Era Rust's separate Privacy Policy.
We apply data protection rules with regard to the applicable UK GDPR, EU GDPR and other data protection laws.
Contact for privacy matters:
hello@azuryth.co.uk
Tebex's Privacy Policy governs its independent processing within the payment system.
25. Changes to these Terms
The operator may amend these Terms in accordance with applicable law.
Reasons for changes may include:
Changes in law.
Security requirements.
Introduction of new services.
Development of existing systems.
Technical or operational changes.
Publishing a new version provides information about the current rules.
Material changes affecting existing contracts require appropriate prior information and the consumer rights prescribed by law.
The unilateral amendment provision does not authorize unlimited or unfair reductions of consumers' contractual rights.
26. Governing law and dispute resolution
New Era Rust's operator is a company registered in the United Kingdom.
The relationship between the operator and user concerning server use is generally governed by the law of England and Wales, provided this does not prejudice mandatory consumer protection provisions applicable in the consumer's country of residence.
Consumers cannot be deprived of the mandatory statutory protection applicable in their country of residence.
Jurisdiction is determined by applicable mandatory laws.
Disputes arising from purchase contracts made through Tebex are governed by the relevant Tebex purchase terms and applicable laws.

28. Final provisions
These Terms contain the general rules for using services associated with the New Era Rust server.
Individual product descriptions, gameplay rules and Tebex purchase terms may supplement them for the relevant matter.
If a provision of these Terms is found invalid or unenforceable, this does not by itself affect the validity of the remaining provisions.
